any car insurance agents in the house?

feel like I'm getting screwed here.  Some punk from North Carolina (Ashville to be exact) side swiped my wife.  We have a police report, his insurance info.  When we called his insurance company they said they will not do anything, ie rental car til they can get a hold of him.  He apparently is not returning their calls.  Is this bogus being that we have a police report stating it was his fault.
