I don't think the pharmacist should be charged with 1st degree murder, but he should be charged.  I was always taught that once the perpetrator is down (this boy wasn't moving), get the hell out of dodge.

I know the story. Maybe he'll settle for some sort of manslaughter and not too long a sentence. Murder for this? No way.

He is 57 years old.  Even a manslaughter charge will see his best remaining years past him when he gets out of jail.

One of the bandits had a pistol.  Once you choose to take part in that type of crime, your life is forfeit in my opinion.

I would fight it.  It takes one sympathetic person to hang the jury.  A 1 in 12 chance of going free.  There is a strong likelihood I would hang such a jury.

I don't have a problem with the fact that he shot the guy, not at all (would have done the same thing myself).  HOWEVER, I do have a problem with the fact that he chased the other robbers out of the store, came back in, went and got the other pistol out of the drawer and dropped five rounds into the immobile person's chest.  IMHO, that goes beyong the boundaries of self-defense.

Any LEO's opinion on this (or retired LEO's)?

See? That's why God invented 12ga. 00 Buckshot shells.

If the first one is well-placed, there's little need for a second shot.

Seriously, maybe the guy went a little overboard, but who among us has been in his shoes? I've had some adrenaline pumping, but has it ever been half as much as this pharmacist?

It appears there may be mitigating circumstances.  The pharmacist had been robbed two times prior to this and the second time he was robbed, he was badly beaten.

After watching the video, what bothers me is  the pharmacist turned his back on this young man lying in the floor after he shot him, not once, but twice.  Common sense tells me that I should NEVER turn my back on a potential threat if I believe that threat is still viable (even in a highly charged emotional state).

Murder No
Self Defense surely

Dropping 5 additional bullets...disgusting...

HOWEVER

He will either get off on a PTSD or some similar diagnosis due to his history

or

He will hang because of the 5 additional shots and if he gets off will have a lovely civil suit against him.

I can't believe that I have to bang my Head against this wall again. But the blows they have just a little more Space in-between them. Gonna take a breath and try again.
