Jolly Rancher lands Fort Bend County third-grader in detention for a week

ORCHARD, Texas – A third-grader at Brazos Elementary was given a week’s detention for possessing a Jolly Rancher.

School officials in western Fort Bend County are defending the seemingly harsh sentence. The school’s principal and superintendent said they were simply complying with a state law that limits junk food in schools.

But the girl’s parents say it’s a huge overreaction.

“I think it’s stupid to give a kid a week’s worth of detention for a piece of candy,” said Amber Brazda, the girl’s mother. "The whole thing was just ridiculous to me."

Leighann Adair, 10, was eating lunch Monday when a teacher confiscated the candy. Her parents said she was in tears when she arrived home later that afternoon and handed them the detention notice.

According to the disciplinary referral, she would be separated from other students during lunch and recess through Friday.

Jack Ellis, the superintendent for Brazos Independent School District, declined an on-camera interview. But he said the school was abiding by a state guideline that banned “minimal nutrition” foods.

“Whether or not I agree with the guidelines, we have to follow the rules,” he said.

The state, however, gives each school discretion over how to enforce the policy. Ellis said school officials had decided a stricter punishment was necessary after lesser penalties failed to serve as a deterrent.

Ellis said failing to adhere to the state’s guidelines could put federal funding in jeopardy.

According to the Texas Department of Agriculture’s website, “The Texas Public School Nutrition Policy (TPSNP) explicitly states that it does not restrict what foods or beverages parents may provide for their own children's consumption.”

Brazos Elementary Principal Jeanne Young, said the problem, in this instance, was that the candy was provided by another student – not the girl’s parents.

The girl’s mother said the incident has taught her daughter a lesson, but not the one her teachers intended.

“I told her, ‘Leighann, unfortunately you’re learning very young that life’s not fair,'” Brazda said.

I'd like to know what that school serves on their school hot lunch menu. Anyone else watch Jamie Oliver's food revolution?

Prove they serve whole foods, and real nutrition, and THEN they can enforce some arbitrary policy.

Edit to add: I love to cook, and I love to cook REAL food. Our children deserve to be fed decently in schools.

The product was originally produced by the Jolly Rancher Company, founded in 1949 by Bill and Dorothy Harmsen of Golden, Colorado.

The type/flavor she had was an apple one, lower left [according to the news report I saw].

So, if I've got this right, a 9 year old takes A piece of candy from ANOTHER kid and gets detention for it? GIVE ME A BREAK!!!

If I were the mother I'd be at the next school board meeting raising some kind of HELL! And that would be AFTER the news media got a GOOD story!!

Lordy, I pack Caleb's lunch every day and (for a joke) I put in one of those red and white mints (like the Sonic does). The kids he eats lunch with thinks it's cute and he usually gives them away to whoever he "likes" that day. I guess the Principal in Linden forgot to read that damn law cause she thinks it's hillarious. His teacher gives "gummy bears" when the kids do an exceptional job on their work. Guess she doesn't know about that law either...

Thanks KOP - now my blood pressure is up for the day!!! It was a little low when I woke up...

HOUSTON -- A week of detention for a 10-year-old caught with a Jolly Rancher at school ended on a sweet note Friday after the state said the school went too far.

Leighann Adair has a sweet tooth but what happened a school this week, left a bad taste in her mouth. The Brazos Elementary third grader was about to eat a piece of candy, but it was taken away.

Jack Ellis, the superintendent for the Brazos Independent School District, said the school was abiding by a state guideline that banned “minimal nutrition” foods.

So that single Jolly Rancher led to detention, which separated her from other classmates at lunch and at recess.

Her parents called the punishment ridiculous.

“I don’t think they treated her fairly. I think the punishment was definitely exaggerated and they should have to apologize to her,” says Amber Brazda, Leighann’s mother.

School officials say they were following state law and were concerned about losing funding.

In a letter to the school system Friday, the Texas Department of Agriculture wrote, “This particular incidence of candy possession as it has been reported by KHOU-TV would not be considered a violation of the state or federal nutrition program and therefore would not have jeopardized your district’s food service funding.”

Leighann’s dad, Michael Brazda, is happy that someone sees his point of view.

“I was glad. I was actually happy that something was coming about it. I was starting to wonder if I would get anything accomplished,” he said.

The detention is now over for the 10-year old and her mom says a valuable lesson was learned.

“If you feel that you’re in the right and they’re wrong and in your heart you know you’re right, then you have to fight for what you believe in,” Amber Brazda said.

The Agriculture Department also says that the nutrition policy is intended to improve the health of Texas youth, not prohibit sharing a little candy.

We've had all this in the UK too (mostly that hypocritical prat Jamie Oliver's fault ) , the school my kids go-to has a healthy school award and there are no unhealthy foods allowed in lunch boxes . But my daughter still has chocolate spread in her sandwiches and a pack of crisps ,no one bats an eyelid .

Like you say it's all to do with money.

Over here....at least within the past 30 or so years, no one is encouraged to think or use his own initiative. Everything is guidelines...literally everything. No one is supposed to use his head because if he were to do so, he'd probably lose it.

I've casually responded to certain events in the news that seem so utterly absurd, with the phrase, "The end times are near".

This time I really mean it.

I have always been interested in history, politics and current events that ultimately shape the times in which I live.

My interest has naturally increased in these matters as I head into the autumn of my life. Hopefully, I've not yet reached my maximum earning level but all of the rules seem to be in flux. Hopefully I remain employed (having made it through three layoff sessions).

Sometimes I read something that could not possibility be considered... so I blow it off chalking it up to blogger BS.

Next thing you know this impossible thing is being considered for legislation, or has been passed in advance of a holiday break, or implemented by executive order on a weekend.

Then you watch C-span and witness the weekly charade of powerful people pointing fingers at other powerful people pointing fingers at one another for show. It's a show because both are getting rich and money is exchanged and the rulers craft the vehicle that keeps all of them in power.

The the private sector, having been subsidized with a promise of our money, tells you how they have returned you tax dollars ahead of schedule and aren't we noble. Turns out it was all BS.

The Government is innocent and the media tells us so. I simply can't believe these people actually say what they say and more so, believe what they are saying. It is astounding.

May you live in interesting times, and from my understanding of history, and the brief history that I have occupied is indeed truly interesting.

The world is getting meaner. Our Planet is changing on every front. The rules are changing and the worlds population is on the move; filling in the economic voids created by the challenge of the differences between desire and ones ability to work within an environment of entitlements.

The "system" is being worked from every angle, on every front and any possible way the Government can craft give-aways with an ultimate motive being retaining power.

Look around. Tell me you're not concerned...

Yikes. I and my friends would be doing hard time. We managed to wage serious war in all our textbooks, and any piece of paper where we could depict very detailed bloodletting. Scores of P-51s shot down Zeros and Messerschmitts on every flyleaf and open space. B 17s, Panzers and Sherman tanks everywhere being pelted with machine gun fire across the bindings and down the pages. Lots of dead or severly disfigured teachers too along with some very inventive depictions of obliterated schools. Severed heads and other body parts everywhere.

Of course later we festooned our texts with mushroom clouds, Migs and Sabre Jets everywhere.

We were beyond lethal, we were psychotic.
