I read and respect your comments. Allow me to offer a different perspective.
Rather than invoking ADA as a form of revenge, perhaps, given the documentation you have, you might consider pursuing the ADA route as a 'trailblazer'.
One successful ADA claim based on CH could set an extremely valuable precedent. Remember, ADA merely calls for employers with over 50 employees to make "reasonable accomodations". I have no idea what type of work you do, but in this 24/7, phone/fax/internet connected world, many jobs can handle 'flex time'. Allowing you to work around your attacks, while still providing the opportunity for you to put in your 40/week sounds like "reasonable accomodation" to me.
Just a thought.
