In the months since I posted the above, I have had one thing brought to my attention.

Members of the Native American Church have the legal right to consume and gather peyote, but not, apparently, psilocybin mushrooms.

Even though many of the Church members use both psilocybin mushrooms and peyote cactus as a sacrament, only peyote is exempt under the law. I have been unable to find a case where a Church member was prosecuted for possession of psilocybin mushrooms, but that doesn't mean that it has never happened.

I apologize for the misinformation. I was misinformed.
