on charges in front of a military tribunal for being suspected of being in the military of whom we are at war with? Isn't that more where the problem lies? Civilians who very well may not be part of their military going in front of a military tribunal is the freedom that we are fighting for? Just by being brought to that body is, in essence, saying you're guilty until proven innocent.
By the way. Yes. Our military code only applies to our military personnel and not others.
