Legal question about the StatDose Kit
Oct 5th, 2011 at 1:32am

If someone wanted / needed a stat dose kit with pen, is it legal to give it to them WITHOUT any medication (of course), or is that illegal ??

I should think whether or not anyone is interested in prosecuting would depend a great deal on the intended and actual end use of the product. If it's used in a homicide, or is discovered in a massive drug bust, and it got out that you are the central supplier, I suppose you'd have problems. If it's for someone who has a need anyway and just ran out, who would know or care? Kinda funny question, that. Blessings. lance

That will vary by state, in California, it's a hypodermic kit, so a misdemeanor to possess or give away without a prescription. But as Lance said.....the chance of anyone filing a case on something like that is nill to none.

I'm not sure it would violate the law without the refill pack.  No needle and no medication.  Either way, if I were to send one, I wouldn't worry about it.
